Muzyn removal from TVARS Board likely

Update:  Due to your support, TVA and a majority of the TVARS Board did not include this item in subsequent proposals.  Thank you very much! 

I will likely be removed from the TVARS Board this week.  TVA’s proposed changes to the rules state that “elected directors may serve only three terms.”  I am currently serving my fifth term as an elected director.  Tony Troyani and Allen Stokes continue to work with John Hoskins, Brian Child and Tammy Wilson to push for a TVARS Board vote on TVA’s or a similar alternative proposal.  They may wait to vote until the quarterly board meeting in Nashville this coming Thursday, March 3.

Suzan Bowman is also supporting my removal from the TVARS Board.  When Tony Troyani asked if the TVARA had a proposal to submit to the TVARS Board, she responded in a February 19, 2016 e-mail with two alternatives which included reductions in vested benefits and stated “We also support 3 year [sic] Term limits for Board members with no grandfathering.”

Only one of Tony Troyani’s or Allen Stokes’ votes is needed to approve the proposal.  The one who most does not want to be bothered dealing with negative employee and retiree feedback will be able to vote against it knowing it will be approved anyway.

Please continue supporting Jim Hovious as an elected director after I am removed.  He has demonstrated time after time that his number one priority as a TVARS director is the fair treatment and well-being of employees and retirees.  I will continue to do all that I can to support him.

I expect that I will be fired soon after I am removed from the TVARS Board.  I have been outspoken in defending TVA employee and retiree interests, and TVA has threatened me in the past with termination for communicating my opinions about TVARS issues.  I planned to work several more years before retiring, but my family and I will be alright.  We have lived with my job uncertainty for many years.  Thank you very much for the outpouring of encouragement, support and prayers given to us.

  1. I am so sorry Leonard! You have been so dedicated to represent the employees on the Retirement Board. I don't understand how they can remove an elected board member before he finishes his term.

  2. Leonard, no matter what happens please keep this Blog going for as long as you can so we can learn what is going on with TVARS. Jim Hovious will have also served 3 years in October.

A Task Assigned to the TVARS Board

The TVARS board is required to recommend a contribution from TVA to be made in fiscal year 2014 prior to the end of the current fiscal year.  (See Section 9B on pages 51-53 of the rules here .)  Since TVA sets its budget months before the end of the fiscal year, it is imperative that this recommended amount be: decided upon by the TVARS board as quickly as possible; sufficient to adequately fund TVARS; and consistent with the amounts charged to ratepayers for pension expense. Why do TVARS board meetings remain closed?

Within the next couple of months, the TVARS board must vote on a contribution amount to recommend that TVA make in fiscal year 2014. In conjunction with the contribution amount, it is possible the vote will include amendments to the rules. In conjunction with the contribution amount in 2009, the rules were amended to: suspend contribution requirements and related actuarial valuations for four years (Section 9B9); suspend the requirement that part of the contribution go to the “excess COLA account,” which was designed to accumulate and grow funds to be used for payment of future COLAs (Sections 9B9, 10D1 and 10D2); and reduce legitimate accrued pension benefits (Sections 6I, 7L and 18C3). This is my personal blog to facilitate communication among TVA employees, retirees and beneficiaries who are members of TVARS and who wish to preserve their retirement benefits. Please join my site and post your comments.  I have been an elected member of the TVA Retirement System (TVARS, or the system) board of directors since 2003. I am not speaking officially for the TVARS board of directors or TVA management. TVARS is an entity legally independent of TVA. Three of the board members are TVA employees (including myself), three are appointed by TVA management (currently all TVA executive managers), and the seventh is generally a retired TVA employee (appointed by the other six). As TVA employees, we all have a duty of loyalty to carry out directives issued by TVA management in our regular TVA jobs.
